Export Licenses Explained

An export license is a document, which indicates that a government has granted a proprietor (licensee) permission to export a certain type of goods to specified countries. The export license is issued by the proper licensing agency after a thorough review of the facts surrounding the specified export transaction.

Export licenses protect the items to be exported and ensure their proper use in the final destination.

The official licensing agency in the United States is The Bureau of Industry and Security (BIS). The agency is responsible for putting into practice the Export Administration Regulations (EAR) aiming to regulate the export of finished commercial goods. The general practice necessitates that any item exported from the United States to a foreign country (commodities, technology or software) should be properly examined and licensed.

Not all finished goods are controlled by the EAR. According to the type of exported item, the appropriate licensing agencies are:

• Defense items are controlled by the Directorate of Defense Trade at the U.S. Department of State.
• Nuclear items and equipment are controlled by the Nuclear Regulatory Commission, while the use of nuclear technology and technical data for nuclear power is being authorized by The Department of Energy's Office of Export Control Policy and Cooperation.
• The export of natural gas and electric power is being regulated by The Office of Imports and Exports in the Department of Energy.
• The export of controlled substances and precursor chemicals is being regulated by the U.S. Drug Enforcement Administration

Not all finished goods require an export license.

In order to assess if a finished good requires an export license, the appropriate licensing agency needs primarily to examine the nature of the item to be exported. The Commerce Department has classified the items that do not require product-specific export licenses as EAR99.

At the second assessment level, any product that does not fall into any of the categories classified as EAR99 needs to be assessed in terms of the end use in the final destination. The Office of Foreign Assets Control (OFAC) at the U.S. Department of Treasury puts into effect economic permits based on U.S. foreign policy and national security goals aiming to eliminate end users who would engage in the production and development of including nuclear, biological, chemical and radiological weapons.
