do i still file a 1099 if my employer does not have all my information to file on my behalf?

I live in Philadelphia, PA and i work in Medford, NJ. I know i would have to pay both state taxes since i work in another state. My employer does not do W-2 ( wish she does though) but pays me personal check every week. I get 50% of what i make for that week. No taxes are taken out. So i am assuming i have to file a 1099. But if my employer never asked me for my personal information such as (social security / address / ) or any paper work to file prior to working, do i still file? how will my employer file without my information.

Another question:
if i am doing a 1099, how much am i going to expect to put out for taxes since i work in another state and i am single. im working part time, so i got paid about $2000 so far for the past couple months only.
answer to IIama - i get paid by commission so that is why i get 50% of what i made. This is a part time job and i started on this job in Oct of 2009. so it doesnt seem much, i know =(

The company is breaking the law, but that is not your problem.

You cannot do a 1099. A 1099 is a form that they give you, not a form that you file on your own.

If you really are an employee, then you must ask for a W-2. When they refuse, or on February 15, whichever is later, you must call the IRS and report them. The IRS will then send a substitute form that you can use instead of the W-2.

If you are an independent contractor (which I tend to suspect), then you do not need any forms from them, and you must report the income on either Schedule C or Schedule C-EZ.
